MELBSKY.COM (Melbourne Sky) Terms of Use
Effective date: 8 October 2026

1. Purpose

These Terms of Use set out the conditions for using the online community and information services (the “Services”) provided by the operator (the “Operator”) of MELBSKY.COM (Melbourne Sky, the “Site”), and the rights, obligations and responsibilities of the Operator and users.

3. Acceptance and Changes to these Terms

  1. These Terms take effect when published on the Site. By using the Services, you agree to these Terms.
  2. The Operator may change these Terms to the extent permitted by law. Changes will be announced on the Site at least 7 days before they take effect (30 days for changes that are unfavourable to users).
  3. If you do not agree to the changed Terms, you may stop using the Services and close your account.

4. Services

The Site provides the following services for Koreans living in Melbourne and Australia: community boards, jobs, share/rent, marketplace, Korean business directory, events/promotions, travel and food, Australian and global news, automatic translation of posts (e.g. into English), and other services determined by the Operator. Some news may be provided from partner sites with the source acknowledged.

5. Registration and Eligibility

  1. You must be at least 16 years old to register. Boards involving transactions or contracts (jobs, share/rent, marketplace) are intended for users aged 18 or over; users under 18 must use them with the consent and supervision of a parent or guardian.
  2. You must provide accurate information when registering and must not use another person’s details or register false information.
  3. Accounts from the previous Melbourne Sky website have been migrated to the new Site and you can log in with your existing ID and password. If you do not want your account migrated, you may request deletion using the contact details below.

6. Account Security

You are responsible for keeping your ID and password secure and must notify the Operator immediately if you become aware of any unauthorised use of your account. Non-members are responsible for keeping the password used to edit or delete their posts.

7. Responsibility for Posts

  1. Authors are solely responsible for their posts. The Operator does not guarantee the accuracy, reliability or lawfulness of any post made by users.
  2. Users must ensure their posts comply with all applicable laws, including Commonwealth and Victorian laws.
  3. Job advertisements must comply with minimum wage and employment conditions under the Fair Work Act 2009 (Cth) and related laws, and must not include discriminatory requirements based on race, sex, age, disability, religion, pregnancy or other protected attributes (including under the Equal Opportunity Act 2010 (Vic)).
  4. Share/rent posts must comply with the Residential Tenancies Act 1997 (Vic) and related laws, including rules on bonds.
  5. Marketplace posts must not offer items that are prohibited or require a licence or permit (such as weapons, illicit drugs, prescription medicines, counterfeit or stolen goods, or regulated animal products).

  1. The Operator may, without prior notice, delete or hide any post, or move it to a more appropriate board, if the Operator considers that it breaches these Terms or the law, or does not suit the purpose of the board.
  2. The Operator will cooperate with legal requirements, including requests from the eSafety Commissioner under the Online Safety Act 2021 (Cth).
  3. If you believe a post infringes your rights, please email the link to the post and the reason to the address below, and we will review and act on it promptly.

10. Copyright and Licence

  1. Copyright in a post remains with its author.
  2. By posting on the Site, you grant the Operator a free, non-exclusive licence to reproduce, edit, transmit and display your post for the purposes of operating and promoting the Services, search engine visibility, automatic translation and mobile optimisation. This licence ends when the post is deleted (except for copies retained for a reasonable period, such as backups).
  3. Uploaded images may be automatically resized or converted to maintain service quality.

11. Transactions Between Users

The Site only provides a place for users to exchange information. The Operator is not a party to, and does not broker or guarantee, any transaction between users, including employment, rental or second-hand sales. Always inspect the item or property, check the terms and verify the other party’s identity before dealing. If you suspect a scam (such as a request for upfront payment), stop the transaction and report it to Scamwatch (www.scamwatch.gov.au) or the police.

12. Advertising and Paid Services

  1. The Site may display third-party advertising, including Google AdSense, and direct advertising. Advertisers are responsible for their advertisements and any dealings with them.
  2. The Operator may offer paid services such as pinning posts to the top of a board or business promotion. Prices, periods and refund conditions will be advised at the time of application.
  3. Paid services are covered by the consumer guarantees under the Australian Consumer Law. Nothing in these Terms limits any rights you have under law that cannot be excluded.

13. Changes to and Suspension of the Services

The Operator may temporarily suspend all or part of the Services for system maintenance, server failure, natural disasters or other unavoidable reasons, and may change the Services as required for operational purposes. Notice will be given in advance where possible.

14. Limitation of Liability

  1. To the extent permitted by law, the Operator is not liable for any loss suffered by users in connection with the free Services, unless caused by the Operator’s wilful misconduct or gross negligence.
  2. The Operator is not responsible for users’ posts, disputes between users or between users and third parties, the content of external linked websites, or the accuracy of automatic translations.
  3. This clause does not apply to any liability that cannot be excluded or limited under the Australian Consumer Law or other laws.

15. Restriction of Use and Account Closure

  1. If a user breaches these Terms, the Operator may issue a warning, delete posts, suspend the user for a period, or permanently restrict their use of the Site.
  2. Members may request account closure and deletion of their personal information at any time by emailing the address below. After closure, parts of public posts (such as content quoted by others or comments) may remain; you may delete them yourself before closing your account or ask us to delete them.

The Operator protects users’ personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Please see the Site’s Privacy Policy for details.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Victoria, Australia and the Commonwealth of Australia. Any dispute relating to the use of the Services is subject to the jurisdiction of the courts of Victoria.
